Court puts hold on new abortion restrictions

Republican lawmakers hugged each other in celebration as the law went into immediate effect. Fifty-nine percent of women who seek abortions are mothers who have decided that they can not parent another child, and 66 percent plan to have children when they are older, Planned Parenthood says.

The Iowa Supreme Court has issued a temporary injunction that immediately blocks a provision of a newly signed law that mandates a three-day waiting period between two appointments before having an abortion.

An Iowa law requiring that women wait 72 hours before having an abortion is scheduled to take effect Friday after a judge refused abortion activists' request to block it.

Senate File 471 additionally bans all abortions starting at 20 weeks with no exceptions for rape, incest, or fatal fetal conditions.

The court's approval of an injunction Friday came shortly after Gov. Terry Branstad signed the measure into law. Abortion activists with Planned Parenthood and the American Civil Liberties Union did not challenge the 20-week ban.

The Iowa Supreme Court ordered the state to file a response to Planned Parenthood's motion for an injunction by noon Monday.

"The act thus imposes a medically unnecessary mandatory delay", they argued, adding that physicians who violate the mandatory delay and additional trip requirements are subject to discipline. They say the new law offers women no benefit and will severely burden their access to abortion.

"The court will then consider whether the injunction should remain in force pending this court's resolution of appellants' application for interlocutory appeal", the one-page order states.

During an April interview with KMA News, Iowa Secretary of State Paul Pate said the bill mostly is about managing the vast amount of voter information in the state.

"We welcome Iowa to the growing collection of states enacting necessary reforms to prevent against voter fraud and boost confidence in our elections", Public Interest Legal Foundation President and General Counsel J. Christian Adams said in an email statement on the law.

Bob Vander Plaats of the Family Leader organization applauded the legislation but said the ultimate goal for the coalition of Iowa groups is to protect unborn life at conception.
