Under advisory sentencing guidelines, Flynn is facing between zero and six months in prison.

In their plea for leniency, Flynn's lawyers used their court filing to complain that the Federal Bureau of Investigation agents decided they "would not warn Flynn that it was a crime to lie during an Federal Bureau of Investigation interview because they wanted Flynn to be relaxed, and they were concerned that giving warning might adversely affect the rapport".

Flynn's calls to Kislyak, during which he made assurances about the incoming administration, were part of a broader effort by senior Trump officials to create foreign policy before they were in power, and they alarmed FBI investigators who were already scrutinizing Flynn as part of the Russian Federation inquiry.

However, he noted that all the participants will be listened to in order to arrive at a consensus on the issue. Whether to exempt Iran from making any cuts was one sticking point in the meeting, said a delegate.

McCabe's memo describes how he called Flynn in January and told the national security adviser that because of recent media coverage of his conversations with the Russian ambassador, FBI Director James B. Comey concluded that Flynn should sit down with two FBI agents.

The mainstream media just spent the past year claiming Contreras' sudden removal from this case meant nothing much at all, and the subsequent 12 months of sentencing delays was due to all that awesome cooperation Flynn was supposedly giving to Mueller for his investigation into Trump and his associates.

In a memo submitted to the court on December 11, Flynn's lawyers explain that then-Deputy Director Andrew McCabe called Flynn on a secure phone to the White House on January 24. American intelligence agencies and Mueller have said Russian Federation was the source of hacked material released by WikiLeaks during the campaign that was damaging to Hillary Clinton's presidential effort. The closest he's gotten to commenting on his case was in a campaign appearance for an ultimately unsuccessful Republican congressional candidate in California earlier this year, telling the crowd he wasn't there "to complain about who has done me wrong or how unfair I've been treated or how unfair the entire process has been". If Flynn would not confirm what he had said, the agents had agreed not to confront him.

Former federal prosecutor Joe diGenova blasted the federal government for what he called "one of the most disgraceful events in American criminal justice". "During their walk through the West Wing, President Donald Trump and some movers who were discussing where to place some art work walked between Strzok and [the other agent], but nobody paid attention to the agents".
