Rod Rosenstein, the deputy attorney general, plans to leave the Justice Department shortly after a new attorney general is sworn into office, according to sources.

If Mr Barr is confirmed, he is likely to take over the role of overseeing the Russian Federation investigation.

"I know the deputy attorney general has always planned to roughly stay around two years", she told "Fox and Friends".

In September, Rosenstein went to the White House expecting to be fired after news reports surfaced that he had discussed secretly recording Trump and invoking a constitutional amendment to remove Trump as unfit for office.

On Wednesday, Republican Senator Lindsey Graham said Barr would permit Mueller to complete the investigation into Russia's role in the 2016 presidential election.

Graham, who chairs the Senate Judiciary Committee, spoke after meeting with Barr, who was making the rounds with senators ahead of his confirmation hearing scheduled for next week.

A person familiar with Rosenstein's thinking told HuffPost that there's now no concrete, specific plan in place for Rosenstein's resignation but said he's expecting to depart after Barr's confirmation.

During his free-wheeling session with reporters, Trump also wrongly claimed that he'd never called for the wall to be concrete. Senate Majority Leader Mitch McConnell has also pledged to block the measures from a vote in the upper chamber.

In May 2017, shortly after the president dumped Federal Bureau of Investigation chief James Comey, Rosenstein appointed Mueller to take over the Federal Bureau of Investigation probe of Russia's meddling in the 2016 election and possible ties between Russians and Trump associates.

On Wednesday, White House press secretary Sarah Huckabee Sanders issued remarks about the reports of Rosenstein's purported departure.

Sen. Lindsey Graham (R-S.C.) told reporters that Barr talked to him about his relationship with Mueller, including the fact that their wives are in a Bible study group together and Mueller has attended two of Barr's daughters' weddings.

Barr has criticized the Mueller investigation in the past, including an unsolicited memo he sent the Justice Department a year ago critiquing Mueller's investigation into whether the president had sought to obstruct justice by firing Comey. The appointment followed the recusal of Sessions because of his work on the Trump campaign and Trump's firing of former Federal Bureau of Investigation director James Comey.

At a news conference in December, Rosenstein said that Mueller's investigation would be "handled appropriately" no matter who is overseeing it.

The source said that Rosenstein is resigning of his own accord, and not being forced out by Trump. Barr's opinion of Mueller is "very high", Graham said.

"The Senate 'should subject Mr. Barr's views to the strictest of scrutiny next week and I still believe, after the revelations about Mr. Barr's unsolicited memo, President Trump ought to withdraw this nomination", Schumer said.
